We believe terms and conditions should be legible to you, the user. The following document will outline the terms that come along with contracting us and or using any of our services. Terms & Conditions

  • By electing to engage the services of and issue payments to Softworks Interactive Inc., you acknowledge that you agree to and are bound by the following terms and conditions:
  • Softworks Interactive Inc. will only execute, perform and or carry out work where an agreement is provided via email or online, with the following refund policy:
    • Full refund: Full refunds will be provided only for bespoke projects or services in cases where work has not been started, or where we are unable to meet the original requirements within the timeframe outlined in the initial agreement.
    • Partial refund: Partial refunds will be provided only for bespoke projects or services if upon evaluation the product and or service does not satisfy the agreements initial brief. In all cases, monies paid from partial refunds will be the total amount paid minus the cost of time spent on the job.
    • No refunds: No refunds will be provided in cases where the bespoke project, product and or service has been approved and the work or service has been completed. Further, due to partial work automations, prepaid services like website care plans will be provided no refunds for cancelations during active billing periods.
  • Should you choose to contract services with another provider for your website, Softworks Interactive Inc. cannot accept liability for losses caused by the unavailability, malfunction and or interruption of either services, or for loss of turnover, sales, revenue, profits or indirect consequential and or special loss. Further, Softworks Interactive Inc. reserves the right to charge for time incurred should the new provider require our expertise and or support.
  • As it pertains to design and development services, once the balance has been paid in full and your website, product and or service is either live or in the cases of graphic or textual works in your possession, it is assumed that the project has been completed to your satisfaction. Any additional work beyond this point is then charged at the hourly rate for development, design, and support or, as part of an ongoing website care plan.
  • If you choose to have administrative rights to your website, you will be able to make modifications and update content on your own. Softworks Interactive Inc. will not be held liable for any changes that you make to your website. Any work and or assistance required to reverse undesired changes to your site will then be charged at the hourly rate for development, design, and or support.
  • All audio, images, photos, text, videos, and other stock submitted by you must be free of copyright infringement. Softworks Interactive Inc. assumes no liability for any copyright infringement resulting from the audio, images, photos, text, videos and or other stock used or published on your website(s).
  • Depending on the project, product, or service, we may at times include third party software(s) on your website to provide functionality and or improve the overall user experience. Given these are third party software(s) hosted by another supplier, we cannot assume responsibility for any loss of services or malfunctions that may arise from their use.
  • Most add-on / plugin software fees are included in the website maintenance care plans; however, if you choose to cancel your maintenance care plan and administer your website yourself, you will need to purchase your own software licenses to continue using these features and or functionalities.
  • We reserve the right to post a screenshot of your completed website, as well as a link to it, on our portfolio page, review websites, and any of our social media profiles.
  • All websites are built to be responsive and can be viewed on laptops, PC’s, tablets, and mobile devices running the latest versions of MS Edge, Mozilla Firefox, Google Chrome and Safari.
  • If you fail to make payment for monthly service fees to Softworks Interactive Inc. for your website maintenance care plan, your care plan will be suspended. Your website maintenance care plan will only be restored after 14 days if you make payment in full for the outstanding balance. Should you fail to issue payment for the outstanding balance, your website will be permanently removed from our systems and all third-party licensing will be stripped after the 14-day wait period. Further, if your website(s) experiences technical problems, malfunctions, or losses of services, that result from licensing deactivation and or removal from our systems, Softworks Interactive Inc. will not be held responsible for any losses of profits and or otherwise that may ensue.
  • A fixed annual price will be charged for all domains managed on behalf of clients. If a client does not pay to keep their domain active, it will not be renewed at the next available cycle, and the customer may lose access to it in the future.
  • Softworks Interactive Inc. disclaims all obligation for any loss of profit resulting from domain name expiration due to a technical fault or any other fault caused by the hosting company or any third party.
  • All draft works (wireframes, boilers, templates, sketches, and outlines) will be developed based on the design brief and information provided by the customer. Additional support charges for any works may be levied if the design brief and or scope of work changes considerably after the initial draft has been prepared.
  • With respect to website development and or design, Softworks Interactive Inc. reserves the right to terminate this agreement without notice if the final payment is not received within 90 days of the final payment due date. In cases of termination due to non-payment, all completed design work will be permanently erased from our platform, and there will be no return. Any domains or email accounts that were registered by and or managed by us will be revoked as well, with no reimbursement due. Further, Softworks Interactive Inc. will not be held responsible for any client losses and or other issues that may arise from termination due to non-payment.
  • Due to a variety of external circumstances, we are unable to provide any assurances about the search engine rankings we will attain for websites. As a result, we Softworks Interactive Inc. cannot be held liable for any changes in your website’s ranks or a drop in its position resulting from modifications in the search engines’ algorithms or other internal factors that they incorporate to rank websites.
  • Softworks Interactive Inc. reserves the right to refuse to handle material that could be reasonably considered harmful, unlawful, or controversial in any way. Further, we reserve the right to distance ourselves and discontinue our relationship with you the client and thus terminate your service(s) without notice if any materials of these natures are found within your accounts on our servers or on your website(s). Violators of this rule will have all accounts immediately terminated as well as all information deleted and will not be entitled to a refund.
  • We, Softworks Interactive Inc. reserve the right to amend these Terms and Conditions at any time.
